sum it upRecap #crimechat April 4, 2013: Today we spoke about wrongful convictions with Nancy Petro. A short introduction to wrongful convictions started this crimechat.

How do we find out about Wrongful Convictions in general?

A: We discover that the victim is alive & well.

Examples:

India 2003, the Reena Devi case. Reena disappeared, her mother ID-ed her dead body but she was found alive while two men were on trial. NOTE 2019: the Tribute of India has reorganized many of their archives and the link is broken. The story still pops up if you do an online search though but you cannot open the article.

Spain 1910: Jose Grimaldos disappeared. An overzealous judge sentenced two men to 18 years in prison. Jose was found alive in 1926.

America 1812: Russell Colvin, Vermont, 1812, was brought back to Vermont just in time to save relatives from execution.

B: The real perpetrator is caught in an unrelated crime and confesses. Examples galore!

C: New evidence is discovered or old evidence is re-examined with new technology such as DNA

America’s first DNA death row exoneration came in 1993 and freed Kirk Bloodsworth. Kirk had been condemned to death for the 1985 rape/murder of a child.

Note that only a fraction of criminal cases involve biological evidence that can be tested for DNA. Evidence from very old cases e.g. 50s/60s is often lost so the real numbers of WC are unknown

Causes of Wrongful Conviction:

1 The eye-witness did not see it correctly e.g. misidentification

2 Lab goof-ups ranging from invalidated theories, not drawing conclusions (so others do) to incorrect handling of evidence

3 False confessions, please see the Richard Lapointe case on my blog.

4 Snitches/Informants who will say what you want in exchange for …

5 Bad lawyer who fall asleep, did not hire their own experts, never did any background searches or even meet the witnesses

6 Prosecutorial misconduct, please see the Zeigler case on my blog.

Any combination of the above 1 through 6 is possible!

The eight myths that Nancy describes in her book about wrongful convictions are:

Myth 1: Everyone in prison claims innocence.

Myth 2: Our system almost never convicts an innocent person.

Myth 3: Only the guilty confess.

Myth 4: Wrongful conviction is the result of innocent human error.

Myth 5: An eyewitness is the best testimony.

Myth 6: Conviction errors get corrected on appeal.

Myth 7: It dishonors a victim to question a conviction.

Myth 8: If the justice system has problems, the pros will fix them.

We touched briefly on the case of Byron Case. His website is here. Please read up on this one. Judging from the tweets, some of the issues in this case are the time line, ballistics, and an unofficial tape recording entered into evidence.

Nancy reported about the Wrongful Convictions Blog and as per request from Susan, ended with the upbeat note that cops and prosecutors are working together more than ever to investigate wrongful convictions! The report from the National Registry of Exonerations is here. Their updates 2012 report can be found here as a pdf file.

Since 2009, I write about unsolved cases that need renewed media attention. I only do research and leave active investigations to the authorities.

My posts cover homicides, missing and unidentified people, wrongful convictions, and forensics as related to unsolved cases.

On book reviews: I only review select works of true crime, crime fiction, and historical fiction/mysteries. The stories have to fit my website's theme, tone, and research. It is my prerogative to not review a book. Please check the FAQ page for more.
