Recap #crimechat April 4, 2013: Today we spoke about wrongful convictions with Nancy Petro. A short introduction to wrongful convictions started this crimechat.
How do we find out about Wrongful Convictions in general?
A: We discover that the victim is alive & well.
Examples:
India 2003, the Reena Devi case. Reena disappeared, her mother ID-ed her dead body but she was found alive while two men were on trial. NOTE 2019: the Tribute of India has reorganized many of their archives and the link is broken. The story still pops up if you do an online search though but you cannot open the article.
Spain 1910: Jose Grimaldos disappeared. An overzealous judge sentenced two men to 18 years in prison. Jose was found alive in 1926.
Pakistan 2006: Malik Taj Mohammed was serving time for murder. Later his victim was arrested for theft in an unrelated crime.
America 1812: Russell Colvin, Vermont, 1812, was brought back to Vermont just in time to save relatives from execution.
B: The real perpetrator is caught in an unrelated crime and confesses. Examples galore!
C: New evidence is discovered or old evidence is re-examined with new technology such as DNA
America’s first DNA death row exoneration came in 1993 and freed Kirk Bloodsworth. Kirk had been condemned to death for the 1985 rape/murder of a child.
Note that only a fraction of criminal cases involve biological evidence that can be tested for DNA. Evidence from very old cases e.g. 50s/60s is often lost so the real numbers of WC are unknown
Causes of Wrongful Conviction:
1 The eye-witness did not see it correctly e.g. misidentification
2 Lab goof-ups ranging from invalidated theories, not drawing conclusions (so others do) to incorrect handling of evidence
3 False confessions, please see the Richard Lapointe case on my blog.
4 Snitches/Informants who will say what you want in exchange for …
5 Bad lawyer who fall asleep, did not hire their own experts, never did any background searches or even meet the witnesses
6 Prosecutorial misconduct, please see the Zeigler case on my blog.
Any combination of the above 1 through 6 is possible!
The eight myths that Nancy describes in her book about wrongful convictions are:
Myth 1: Everyone in prison claims innocence.
Myth 2: Our system almost never convicts an innocent person.
Myth 3: Only the guilty confess.
Myth 4: Wrongful conviction is the result of innocent human error.
Myth 5: An eyewitness is the best testimony.
Myth 6: Conviction errors get corrected on appeal.
Myth 7: It dishonors a victim to question a conviction.
Myth 8: If the justice system has problems, the pros will fix them.
We touched briefly on the case of Byron Case. His website is here. Please read up on this one. Judging from the tweets, some of the issues in this case are the time line, ballistics, and an unofficial tape recording entered into evidence.
Nancy reported about the Wrongful Convictions Blog and as per request from Susan, ended with the upbeat note that cops and prosecutors are working together more than ever to investigate wrongful convictions! The report from the National Registry of Exonerations is here. Their updates 2012 report can be found here as a pdf file.
The verbatim text is below.

Vidocq_CC | Welcome, Nancy! #crimechat | Thu, 04 Apr 2013 14:03:19 +0000 |
Vidocq_CC | @Nancypetro Good Morning!!! #crimechat | Thu, 04 Apr 2013 14:03:38 +0000 |
nancypetro | Good morning, Nic. Thanks for this opportunity to talk about cold cases and wrongful conviction. I'm honored by the invitation. #crimechat | Thu, 04 Apr 2013 14:03:42 +0000 |
nancypetro | You've just given a great primer to wrongful conviction! #crimechat | Thu, 04 Apr 2013 14:04:06 +0000 |
Vidocq_CC | @nancypetro And we have more folks joining us. I just tweeted some general information about WC. #crimechat | Thu, 04 Apr 2013 14:04:41 +0000 |
Free_Byron_Case | @Vidocq_CC This sounds like Kelly Moffett, that main "eyewitness" in Byron's case. #crimechat | Thu, 04 Apr 2013 14:04:48 +0000 |
nancypetro | I would add the first widely recorded wrondgul murder conviction of the Bourne brothers in Vermont in 1819. #crimechat | Thu, 04 Apr 2013 14:04:51 +0000 |
Vidocq_CC | @nancypetro Cold Cases can involve WC so yes, I am all for exploring them! #crimechat | Thu, 04 Apr 2013 14:05:04 +0000 |
nancypetro | As it turns out, just before one of the brother's execution, the victim turned up alive and well. #crimechat | Thu, 04 Apr 2013 14:05:57 +0000 |
Vidocq_CC | @nancypetro I did, added the case under victim's name, Russell Colvin, see stream #crimechat | Thu, 04 Apr 2013 14:06:11 +0000 |
nancypetro | Wrongful conviction & cold cases are related: Many wrongful convictions mask a cold case because the real perpetrator is unknown. #crimechat | Thu, 04 Apr 2013 14:06:17 +0000 |
Free_Byron_Case | For a great intro into wrongful convictions follow @Vidocq_CC #crimechat | Thu, 04 Apr 2013 14:06:22 +0000 |
Vidocq_CC | @Free_Byron_Case Explain the case to us and thanks for joining! #crimechat | Thu, 04 Apr 2013 14:06:50 +0000 |
nancypetro | Cold cases created by wrongful conviction don't get attention from local authorities who believe the case is closed, not cold. #crimechat | Thu, 04 Apr 2013 14:07:32 +0000 |
Vidocq_CC | @nancypetro Correct, but we need to read carefully to see the overlap. #crimechat | Thu, 04 Apr 2013 14:07:39 +0000 |
Vidocq_CC | @Free_Byron_Case Make sure you add the hashtag. Do you use http://t.co/hMOnlVaKyd? They do it for you. Nice and easy! #crimechat | Thu, 04 Apr 2013 14:08:19 +0000 |
Free_Byron_Case | @Vidocq_CC Murder in 1997, wrongfully convicted in 2002 by an embittered ex gf who has previously blamed the victims ex bf #crimechat | Thu, 04 Apr 2013 14:08:58 +0000 |
Vidocq_CC | @nancypetro Exactly and that is what hinders Zeigler. Everyone stopped looking after he got arrested! #crimechat | Thu, 04 Apr 2013 14:09:02 +0000 |
nancypetro | Sometimes the only way to correct a wrongful conviction is to solve the case...identify the true perp with strong evidence. #crimechat | Thu, 04 Apr 2013 14:09:05 +0000 |
Vidocq_CC | @Free_Byron_Case Is there a website for the Byron Case? #crimechat | Thu, 04 Apr 2013 14:09:52 +0000 |
Free_Byron_Case | @Vidocq_CC No physical evidence. A contradictory 'eyewitness'. No motive. #crimechat | Thu, 04 Apr 2013 14:10:03 +0000 |

Vidocq_CC | @nancypetro In your experience, how likely is it for a cold case to get re-examined? #crimechat | Thu, 04 Apr 2013 14:10:26 +0000 |
Vidocq_CC | @Free_Byron_Case That already sounds fishy! #crimechat | Thu, 04 Apr 2013 14:10:46 +0000 |
nancypetro | In many high-profile cases of suspected wrongful conviction supporters may need to solve the case to free the innocent. #crimechat | Thu, 04 Apr 2013 14:11:05 +0000 |

Free_Byron_Case | @Vidocq_CC The Skeptical Juror - Trial of Byron Case is a great book that calls out all that is wrong with the case #crimechat | Thu, 04 Apr 2013 14:11:47 +0000 |
nancypetro | Any newly discovered evidence should be sufficient to open a cold case. Of course, it's not easy to find. #crimechat | Thu, 04 Apr 2013 14:12:13 +0000 |
Free_Byron_Case | @Vidocq_CC That would be great. We have an information packet if you are interested #crimechat | Thu, 04 Apr 2013 14:12:14 +0000 |
Vidocq_CC | @nancypetro And many of those supporters are fist called crazy but they continue, spending their own money to correct a wrong. #crimechat | Thu, 04 Apr 2013 14:12:17 +0000 |
Vidocq_CC | @Free_Byron_Case OK, will need to see if my local library has that book. #crimechat | Thu, 04 Apr 2013 14:12:41 +0000 |
Free_Byron_Case | @nancypetro That is our hope since all his appeals have been denied. We just need a ballistic and time of death expert #crimechat | Thu, 04 Apr 2013 14:13:03 +0000 |
Vidocq_CC | @nancypetro And then it has to be introduced to the courts ... procedurally barred! #crimechat | Thu, 04 Apr 2013 14:13:07 +0000 |

Vidocq_CC | @nancypetro Please explain the Elkin case for us. #crimechat | Thu, 04 Apr 2013 14:14:50 +0000 |
Free_Byron_Case | @Vidocq_CC The timeline is terribly distorted. The eyewitnesses testimony of timing is impossible given the TOD factors. #crimechat | Thu, 04 Apr 2013 14:14:52 +0000 |
Vidocq_CC | @Free_Byron_Case Is the time line described in the book with a graphic? If not, can you get that to me? #crimechat | Thu, 04 Apr 2013 14:15:59 +0000 |
Free_Byron_Case | @nancypetro That is what we are trying to do now. Just had a fundraiser last month. #crimechat | Thu, 04 Apr 2013 14:16:25 +0000 |
nancypetro | Clarence Elkins was convicted of killing his mother-in-law & raping his niece based on the misidentification of the child victim. #crimechat | Thu, 04 Apr 2013 14:16:39 +0000 |
Vidocq_CC | @HALO_7 And that is wrong, period. If you did the crime, you should be sentenced regardless of a country's history. #crimechat | Thu, 04 Apr 2013 14:17:01 +0000 |
LAMurderCop | RT @Vidocq_CC: And then we have America’s first WC murder case of Russell Colvin, Vermont, 1812 http://t.co/dvTcswcyWb #crimechat | Thu, 04 Apr 2013 14:17:11 +0000 |
nancypetro | He was identified as the perp within hours of the crime. No physical evidence linked him to it. #crimechat | Thu, 04 Apr 2013 14:17:12 +0000 |
Vidocq_CC | @nancypetro How old was the child at that time? #crimechat | Thu, 04 Apr 2013 14:17:23 +0000 |
nancypetro | He was convicted and sentenced to life in prison. His wife Melinda dedicated herself to finding her mother's killer. #crimechat | Thu, 04 Apr 2013 14:17:58 +0000 |
Vidocq_CC | @LAMurderCop Hi Sal! Thanks for the RT! How are you? #crimechat | Thu, 04 Apr 2013 14:18:10 +0000 |
nancypetro | The niece was only 6 years old and beaten in the dark of night in her bed. #crimechat | Thu, 04 Apr 2013 14:18:47 +0000 |
nancypetro | The case went up and down the appeals process and even DNA excluding Clarence did not win him a new trial. #crimechat | Thu, 04 Apr 2013 14:19:32 +0000 |
LAMurderCop | @Vidocq_CC Doing well!! Thanks. Love the tweets #crimechat | Thu, 04 Apr 2013 14:19:52 +0000 |

nancypetro | Eventually, Mark Godsey, Dir. of the Ohio Innocence Project, contacted my husband Jim Petro, then OH Atty. Gen. for assistance. #crimechat | Thu, 04 Apr 2013 14:20:26 +0000 |
Vidocq_CC | @LAMurderCop Any cases that stand out for you as a cop, wrongful convictions? #crimechat | Thu, 04 Apr 2013 14:20:39 +0000 |
